1. Scope and Seller

These general conditions govern purchases made on the Fragmenta online shop, a brand of PROFUMATORIA S.R.L. (hereinafter the “Seller”):

Sales to consumers are regulated by the Consumer Code (Legislative Decree 206/2005) and by the rules on electronic commerce (Legislative Decree 70/2003). Placing an order implies full acceptance of these conditions.

2. Products and Prices

Images and descriptions of products are for illustrative purposes; slight variations do not alter the nature of the product. All prices are expressed in Euros and include VAT. Any shipping costs are indicated separately and clearly shown before order confirmation. The price applied is the one published at the time the order is placed.

3. Conclusion of the Contract

The order sent through the site constitutes a contract proposal. The contract is concluded with the order confirmation sent via email by the Seller. The Seller may not accept orders in case of unavailability of the product, incomplete data or payment anomalies; in this case any amount already paid will be refunded.

5. Shipping and Delivery

Products are shipped via express courier to the address indicated during the order process, or made available for pickup at the collection point selected at checkout. Indicative delivery times are 2-5 working days from shipping. Upon delivery, the customer is invited to check the integrity of the package and report any damage to the courier and to the Seller. The risk of loss or damage to the goods passes to the consumer only with material delivery.

6. Right of Withdrawal

Pursuant to articles 52 et seq. of the Consumer Code, the consumer can withdraw from the contract within 14 days of receiving the products, without having to provide any reason. The withdrawal is exercised directly online, using the special “Withdraw from the contract here” function available in the order details of the reserved area and in the link present in the shipping and delivery emails: the declaration is registered with date and time and you will receive a confirmation email. Alternatively, you can send an explicit declaration to hello@fragmentavenezia.com, indicating the order number. The products must be returned without undue delay and in any case within 14 days of the communication, intact and in their original packaging; return costs are borne by the consumer. The refund of the amount paid, standard delivery costs included, takes place within 14 days of the withdrawal communication, using the same payment method used (the Seller may withhold the refund until receiving the goods or proof of their shipment). Pursuant to art. 59, letter e), of the Consumer Code, the withdrawal is excluded for sealed products that are not suitable for return for hygienic reasons, if the seal has been removed after delivery.

7. Legal Warranty of Conformity

All products are covered by the legal conformity warranty of 2 years from delivery, pursuant to articles 128 et seq. of the Consumer Code. In case of lack of conformity, the consumer has the right, at their choice and without expense, to restore conformity by replacement or, in the cases provided by law, to a price reduction or termination of the contract. To activate the warranty, write to hello@fragmentavenezia.com indicating the order number and the defect found.

8. Applicable Law and Jurisdiction

These general conditions are governed by Italian law. For disputes with consumers, the court of the place of residence or domicile of the consumer, if located in the Italian territory, has exclusive jurisdiction. The consumer resident in the European Union can also resort to Alternative Dispute Resolution (ADR) procedures provided by current legislation.
